Is My Whistleblower Matter a CEPA Case or a Qui Tam Case?

“Whistleblower” can describe more than one kind of legal matter. Identifying the issue early helps determine what information counsel needs and which deadlines or procedures may apply.

Employment retaliation

A CEPA claim focuses on prohibited retaliation against an employee for qualifying whistleblowing. It may arise from a safety concern, a suspected legal violation or another subject within the statute.

Describe both concerns to counsel

If you believe false billing occurred and that you were punished for questioning it, explain both issues. Do not assume that discussing an employment claim means a firm has undertaken a qui tam case or a regulatory complaint.
