Whistleblower & CEPA

New Jersey CEPA: Frequently Asked Questions

Do I have to be fired before calling a lawyer?

No. A consultation can address an ongoing workplace situation. Identify any pending meeting, disciplinary response or agreement that may require a decision.

What if I cannot prove the wrongdoing actually occurred?

CEPA’s reasonable-belief requirement does not invariably require proof of an actual underlying violation. The basis for the belief matters. See Dzwonar v. McDevitt and our protected-activity guide.

Must my complaint have been in writing?

A verbal complaint may matter, but proving its content can be harder. Different notice rules may apply to public-body disclosures. Read Internal complaints and outside reporting.

What if reporting concerns was my responsibility?

That does not automatically defeat protection. Read Watchdog employees and CEPA.

Can I send documents with my first inquiry?

Begin with a brief description and the names needed for conflict screening. Ask the firm how to submit documents. Do not send patient records or confidential employer materials through the initial form.

How quickly must I act?

Deadlines can be short. Read CEPA filing deadlines and seek an individual review of your dates.

Does every whistleblower case involve a government reward?

No. An employment-retaliation claim and a qui tam action serve different purposes. Read CEPA and False Claims Act claims.

What will representation cost?

Ask about consultation fees, proposed fee arrangements and responsibility for litigation expenses. Any engagement should identify its terms and scope. This website does not promise a particular fee arrangement.

Will the firm take my case?

That decision follows review of the facts, conflicts, legal issues and proposed scope of work. A consultation request alone does not establish representation.
